Terms of Service

These Terms of Service ("Terms") govern your access to and use of the NextStat Ads platform at ads.nextstat.io ("Service"), operated by NextStat, S.L. ("NextStat", "we", "us"). By using the Service, you agree to these Terms.

1. Service Description

NextStat Ads is a marketing analytics platform that connects to your advertising accounts (Google Ads and other supported platforms) to provide:

  • Sequential A/B testing with statistical rigor
  • Campaign performance attribution
  • Metric forecasting with confidence intervals
  • Anomaly detection
  • Historical experiment meta-analysis

2. Account Registration

  • You must provide accurate, current information during registration
  • You are responsible for maintaining the security of your account credentials
  • You must be at least 16 years old to use the Service
  • One person or legal entity per account; accounts are not transferable
  • You must notify us immediately of any unauthorized use of your account

3. Plans and Billing

3.1 Free Tier

The Free tier includes up to 3 active experiments, 1 connected ad account, and 30 days of historical data. No credit card is required.

3.2 Paid Plans

  • Paid plans (Pro, Agency) are billed monthly or annually in advance
  • Prices are listed in USD and do not include applicable taxes
  • You may upgrade, downgrade, or cancel at any time; changes take effect at the next billing cycle
  • Refunds are not provided for partial billing periods

3.3 Usage Limits

Each plan has defined limits on active experiments, connected accounts, data history, and compute usage. Exceeding limits may result in temporary restrictions until the next billing cycle or plan upgrade.

4. Google Ads Integration

Google API Services. Your use of the Google Ads integration is also subject to the Google API Terms of Service.
  • You authorize NextStat to access your Google Ads account data as described in our Privacy Policy
  • You represent that you have the authority to grant this access for the Google Ads accounts you connect
  • You may disconnect your Google Ads account at any time through the dashboard
  • We store OAuth refresh tokens encrypted; access tokens are short-lived and not persisted
  • We are not responsible for changes to Google Ads API availability or functionality

5. Acceptable Use

You agree not to:

  • Violate any applicable law or regulation
  • Access accounts or data you do not have authorization for
  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service to send spam, malware, or engage in fraudulent activity
  • Resell or redistribute the Service without a written agreement
  • Scrape, crawl, or automatically extract data from the Service beyond API rate limits

6. Intellectual Property

  • Our IP — The Service, including its algorithms, interfaces, documentation, and branding, is owned by NextStat. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service
  • Your Data — You retain all rights to your data. We claim no ownership of your advertising data, experiment configurations, or analysis results
  • Feedback — If you provide suggestions or feedback, we may use it to improve the Service without obligation to you

7. Data and Privacy

Our collection and use of your data is governed by our Privacy Policy. By using the Service, you acknowledge and agree to its terms.

8. Service Availability

  • We aim for high availability but do not guarantee uninterrupted service
  • Planned maintenance will be communicated in advance when possible
  • We may modify, suspend, or discontinue features with reasonable notice
  • API rate limits and compute quotas apply per plan tier

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Service is provided "as is" without warranties of any kind, express or implied
  • NextStat is not liable for any indirect, incidental, consequential, or punitive damages
  • Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim
  • We are not responsible for decisions you make based on the statistical analyses, forecasts, or recommendations provided by the Service

10. Indemnification

You agree to indemnify NextStat from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

  • You may terminate your account at any time through the dashboard or by contacting support
  • We may suspend or terminate your account for violation of these Terms with prior notice when practicable
  • Upon termination, your data will be retained for 30 days, then permanently deleted
  • Provisions that by their nature should survive termination will survive (including Sections 6, 9, 10, and 12)

12. Governing Law and Disputes

  • These Terms are governed by the laws of Spain
  • Disputes will be resolved in the courts of Valencia, Spain
  • Nothing in these Terms limits your rights under mandatory consumer protection laws of your jurisdiction

13. Changes to These Terms

We may update these Terms. Material changes will be communicated via email or in-app notification at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
